Effective April 1, 2006, New York State has enacted a year-round exemption from the 4 percent state sales tax on the purchase of clothing, footwear, and items to make or repair exempt clothing, costing less than $110 per item* or pair. Chautauqua County also enacted a year-round exemption from its 4.25 percent local sales tax on clothing and footwear. It should be noted that there is no limitation on the cost of eligible items of clothing and footwear to qualify for Chautauqua County’s exemption. In summary, no state or county tax will be charged on clothing under $110. The 4 percent state tax will be applied on clothing items costing $110 or more as stated above.
